TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

These Terms of Service ("Terms") govern your access to and use of the website, platforms, sandbox environments, workshop portals, and related services (collectively, the "Services") provided by OneBlink Inc ("OneBlink," "we," "us," or "our").

By accessing or using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If OneBlink and your organization have entered into a separate written agreement (such as a master services agreement, subscription and services agreement, or statement of work), the terms of that agreement govern in the event of any conflict with these Terms.

2. DESCRIPTION OF SERVICES

OneBlink provides managed ephemeral sandbox environments and hands-on workshop infrastructure, including:

• Provisioning of isolated, pre-configured cloud environments in dedicated accounts
• Workshop portals with federated, time-limited access for participants
• Automated credential distribution and environment lifecycle management (provisioning through teardown)

The Services are intended for business and professional use only.

3. ACCOUNTS AND ACCESS

• You must provide accurate and complete information when registering for the Services or a workshop
• You are responsible for maintaining the confidentiality of credentials issued to you and for all activity that occurs under your access
• Credentials are issued to you individually and may not be shared, transferred, or resold
• You must notify us promptly at support@oneblink.ai of any unauthorized use of your credentials

4. ACCEPTABLE USE

You agree not to use the Services to:

• Violate any applicable law or regulation, or the acceptable use policies of underlying cloud providers
• Mine cryptocurrency, send unsolicited communications, or host production workloads in sandbox environments
• Attempt to access accounts, environments, or data not provisioned to you
• Probe, scan, or test the vulnerability of the Services except as expressly authorized in a workshop exercise
• Interfere with or disrupt the integrity or performance of the Services
• Upload malicious code or content that infringes third-party rights
• Exceed usage limits or resource quotas associated with your sandbox environment

We may suspend or terminate access immediately for violations of this section.

5. WORKSHOP RESOURCES AND SANDBOX ENVIRONMENTS

• Access to workshop resources is provided for the duration of the applicable workshop or engagement only
• Environments may be subject to resource limits, service restrictions, and monitoring
• We may modify, suspend, or terminate environments for security, cost, or operational reasons
• Workshops may be delivered in collaboration with a software vendor or partner ("Workshop Host"); your use of the Workshop Host's software is subject to that vendor's own terms and licenses

6. INTELLECTUAL PROPERTY

All intellectual property rights in the Services, including workshop content, lab guides, portal software, and provisioning tooling, are owned by OneBlink Inc or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use these materials solely for participating in the applicable workshop or using the Services as intended.

You may not copy, modify, distribute, sell, or lease any part of the Services or workshop materials, nor reverse engineer or attempt to extract the source code of any software provided, except to the extent applicable law prohibits these restrictions or you have our written permission.

You retain all rights to data and content you create within a sandbox environment, subject to the ephemeral nature of those environments described in Section 5.

7. FEES

Workshop participation is typically provided at no charge to participants, with costs borne by the Workshop Host under a separate commercial agreement. Where the Services are provided under a paid engagement, fees, invoicing, and payment terms are set out in the applicable order form, statement of work, or written agreement.

8. CONFIDENTIALITY AND PRIVACY

Our collection and use of personal information is described in our Privacy Policy. Each party agrees to protect the other party's confidential information disclosed in connection with the Services with at least reasonable care and to use it only for purposes of the engagement.

9. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT SANDBOX ENVIRONMENTS WILL BE AVAILABLE FOR ANY PARTICULAR DURATION.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONEBLINK INC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONEBLINK'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO ONEBLINK FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).

11. INDEMNIFICATION

You agree to indemnify and hold harmless OneBlink Inc and its officers, employees, and agents from any claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Services, or your violation of any law or third-party right in connection with your use of the Services.

12. TERMINATION

• You may stop using the Services at any time
• We may suspend or terminate your access at any time for violation of these Terms, for security reasons, or upon conclusion of the applicable workshop or engagement
• Upon termination, your right to access the Services ceases and any sandbox environments provisioned to you will be destroyed
• Sections 6, 8, 9, 10, 11, and 13 survive termination

13. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in King County, Washington, and each party consents to the jurisdiction of those courts.

14. CHANGES TO THESE TERMS

We may update these Terms from time to time. Changes will be indicated by updating the "Last updated" date at the top of this page. Material changes will be communicated via email or prominent notice on our website. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
